Eligibility for Registering a Yacht Under the Malta Flag

Under Maltese law, yacht registration is accessible to individuals and entities from various nationalities, ensuring flexibility and inclusivity. Specifically, the following may register a yacht or vessel under the Malta flag:

  • Maltese Nationals
  • EU/EEA/Swiss Nationals or Companies: Individuals or corporations based within the European Union, European Economic Area, or Switzerland.
  • Third-Country Nationals: Entities outside these regions which possess legal personality to the satisfaction of Malta’s registrar of shipping are accepted; however, third-country individuals would not be able to own and register a yacht under the Malta flag unless through a company which possess legal personality to the satisfaction of Malta’s registrar of shipping.

Malta Yacht Registration Process

The process begins with a provisional registration, followed by permanent registration. The key steps for a provisional registration include the submission of initial documentation to Transport Malta and the issuance thereafter of a Provisional Certificate of Malta Registry, valid for six months, which can be extended up to one year. The attainment of the permanent registration is contingent upon the completion of additional requirements imposed by Transport Malta and payment of the relevant fees with the authority. Failure to complete permanent registration within the specified period necessitates a fresh application, including re-submission of forms and payment of new fees. Once obtained, permanent certification is renewable annually from the date of initial registration.

Transitioning Between Registration Types

Switching between registration types under the Maltese flag is also a straightforward process. Switching from a commercial to a pleasure registration is a less complex transition due to fewer criteria for private use. On the other hand, switching from a pleasure to a commercial registration is subject to specific conditions, including having a minimum length of 12 meters, does not carry cargo, and carries no more than 12 passengers. Commercial certification also requires a surveyor-issued Commercial Certificate of Survey and International Tonnage Certificate.
